THE BHUMJAITHAI-LED government’s executive decree to streamline a maximum of 400 billion baht in borrowed funding was today (July 9) judged by the Constitutional Court as constitutional, thus warranting the already implemented economic and energy salvage schemes under the controversial law for which legislators have yet to pass approval in retroactive fashion.
The Constitutional Court judges voted 7:2 to rule the executive decree constitutional in regard to the yet-contentious loan package supposedly designed to address economic slumps primarily caused by sharp increases in world energy prices on emergency basis as well as revamp Thailand’s energy management systems, given the 400 billion baht sum in borrowed funding.
Prime Minister Anutin Charnvirakul has earlier commented that the sought-after loans will be substantially procured from domestic financial sources rather than from abroad and pledged to see to it that the whole borrowed funding scheme be by no means prone to a possible conspiracy of corruption and embezzlement as largely feared among government critics.
Half of the total 400 billion baht loan package was reportedly designed to finance the government’s questionable energy solution schemes which the People’s-led opposition invariably contended as being largely unhinged on an emergency basis and that they could have been merely proposed as legislation in lieu of the executive decree.
The executive branch may issue an executive decree which could be implemented supposedly on an emergency or necessity basis prior to being approved at a later date by the legislative branch, particularly in regard to energy crises and natural disasters, among other critical factors.
